Terms of Service

You must be at least 18 and able to enter a binding agreement. You are responsible for accurate account information, protecting your credentials, and activity performed through your account. Tell us promptly if you suspect unauthorized access.

You may use Exergy Analyst only in compliance with applicable law and these terms. Do not use it to interfere with the service, bypass limits or security controls, access another person's data, introduce malicious content, violate intellectual-property or privacy rights, or support unlawful or dangerous activity.

You retain ownership of files, prompts, company context, and other material you provide. You give us a limited permission to host, copy, transmit, transform, and process that content only as needed to operate, secure, support, and improve the service.

You represent that you have the rights needed to provide the content and instruct us to process it. You are responsible for deciding whether confidential, regulated, export-controlled, personal, or third-party information may be used with the service.

Exergy Analyst is a decision-support tool, not a licensed engineer, financial adviser, lawyer, safety authority, or certification body. Outputs can contain errors, omissions, uncertain assumptions, or provider failures. High-stakes outputs are intended to state what the available data supports and what it cannot prove; you remain responsible for checking sources, calculations, constraints, and suitability before relying on them.

Independent verification labels apply only when a deterministic procedure re-established the claim. Model agreement, fluent prose, confidence language, or a generated report is not independent verification. Do not use an output as the sole basis for safety-critical, permitting, medical, legal, employment, credit, or investment decisions.

Paid plans are billed through Square at the price and cadence shown at checkout. Taxes may apply. Plan features and usage allowances are described on the pricing page and may change prospectively with reasonable notice.

You may schedule cancellation from Billing Settings. Unless checkout or applicable law says otherwise, access continues through the paid billing period and the subscription does not renew after the effective cancellation date. Fees already paid are non-refundable except where required by law or expressly agreed by us. Billing questions can be sent to support.

We may add, change, suspend, or discontinue features, integrations, models, limits, or beta capabilities. We aim to preserve customer work and communicate material changes, but the service may occasionally be unavailable or lose access to a third-party dependency.

We may suspend or terminate access when reasonably needed to protect users or the service, respond to legal obligations, address non-payment, or enforce these terms. You may stop using the service at any time and can use Account Settings to delete your data.

The service, interface, software, branding, documentation, and underlying materials are owned by Exergy Lab or its licensors. Except for rights expressly granted in these terms, no rights are transferred to you. Feedback may be used without restriction or obligation.

To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, or uninterrupted availability.

To the extent permitted by law, Exergy Lab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity arising from the service. Our aggregate liability for claims relating to the service will not exceed the amount you paid us for the service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent allowed.

We may update these terms. We will post the new effective date and provide additional notice when required. Continuing to use the service after an update takes effect means you accept the revised terms.
